Introduction and Agreement
This website (“Site”) is owned by Burnt Studios (Pty) Limited (“the Company” / “us” / “we”). Burnt Studios means Burnt Studios PTY LTD (Registration number: 2018/469922/07), trading as Burnt Studios in the Republic of South Africa.
 
The Site incorporates the Burnt Studios Online Site and, except where the context otherwise indicates, references to “the Site” include the Burnt Studios Online Site. The Site promotes the sale of the Company’s products as well as other products (collectively “the Products”).
By shopping or browsing on this Site, you:
  • represent and warrant that you have read and understood these terms and conditions as well as the policies displayed on this Site; and
  • agree to be bound by these terms and conditions as well as the policies (collectively “the Agreement”).
PLEASE DO NOT USE THIS SITE IF YOU DO NOT ACCEPT, AND AGREE TO BE BOUND BY, THIS AGREEMENT.
 
Product pricing and availability
The Products displayed on this Site are subject to availability. The Company reserves the right, without prior notice, to discontinue or change pricing or specifications on Products and services offered on this Site without incurring any liability whatsoever.

 

Shipping Rates

We ship locally, in South Africa, and internationally.

Local delivery time is 1-5 business days (depending on delivery location).

Shipping for orders under R1250 is charged at a flat rate of R80.
Orders over R1250 enjoy free shipping.

Expected delivery time frames:
Cape Town and surrounds: ±1-2 business days
Main Centres (Johannesburg, Pretoria, Durban etc.): ±2-3 business days
Outlying Areas: ±3-5 business days

International delivery time is around 7 business days. 

International shipments are handled by DHL. They have an automatic system that quotes you on shipping according to your location. Simply enter your delivery address and you will see what the shipping will cost you.

Delays may occur as a result of customs clearance or availability on air freight planes. 

You will receive an email as soon as your order has been shipped. The email will include a tracking number and a link to where you can track your order.

NOTE: The customer is responsible for any and all taxes and duties that the package attracts when entering the destination country. Burnt cannot be liable for any additional costs that the package might incur.

 

Exchanges & Returns

If an item is to be returned you need to have all the original packing, labels (still on the products), sanitary stickers (when it is Swimwear), all items must be clean, unworn, unwashed & unused. Customers wishing to exchange or return merchandise must fill out the exchange form within thirty (30) days after receiving the parcel.
Regarding returns, you will be credited with the ZAR amount of the returned item in the form of a Burnt Studios voucher (Please note: No returns/credit on the shipping costs).

We offer one free exchange per local order, shipped within the parameters of South Africa. After that, local shipping is calculated at R80.00 one way. For international exchanges, the customer is responsible for the shipping costs and any relevant duties of an exchange.

 

To ensure that our customers to have a safe and consisted experience, Burnt will handle any returns and exchanges under the under the CPA or the Electronic Communications and Transactions Act 2002 (“ECT Act”). We will happily accept returns or exchanges purchased through our direct sales channels, i.e. the official Burnt websites (burnt.co.za and burnt.co) as well as our Burnt retail stores within 30 days after purchase. We can not accept or allow any exchanges or returns purchased through a 3rd party.

 

Sale items:  Sale items can only be exchanged for another size or a gift card. Please note that a shipping charge of R80 is applicable to arrange a courier pick up and drop off. No returns, exchanges or refunds are allowed on swimwear, underwear, socks, earrings, eBooks or gift cards.

Please note, we can not guarantee the exchange of limited edition items since certain sizes might be out of stock and not made anymore.   

Should you use your product and spot a factory fault within 30 days of receiving it, Burnt will then replace that item for you. Please email support@burnt.co.za for more info. Size labels and care labels on the inside of garments are not included and garments cannot be replaced if the printing on the INSIDE of a garment; splinters, fades or comes loose. As the size and care labels are worn directly in contact with the skin, we make use of softer printing and fabrics to ensure a comfortable fit. This results in the printing getting faded easier and is therefore considered standard wear and tear.

The following will NOT be regarded as defects and will not entitle you to a return under this section: 

  • faults resulting from normal wear and tear;
  • damage arising from negligence, user abuse or incorrect usage of the product;
  • damage arising from a failure to adequately care for the product;
  • damage arising from unauthorised alterations to the product; and
  • where the specifications of a product, although accurately described on the Website and generally fit for its intended purpose, do not suit you.
Please note, the Burnt Team will first examine the item by means of either image or physical examination. Burnt reserves the right to not grant an exchange if deemed that the fault is not a factory fault.
If any damage occurs outside of the 30-day window, no replacement will be made since we are unable to control how the product was used or handled in that timeframe.
Discount codes
Burnt reserves the right to remove all discount codes on major sale days such as Black Friday or a Flash Sale. No previously acquired discount codes  (including discount codes obtained via scratch cards) can be applied on such days. 
 
Colours
We have made every effort to display as accurately as possible the colours of the Products that appear on the Site. As the actual colours you see will depend on your computer’s monitor we cannot guarantee, however, that your monitor’s display of any colour will be 100% accurate. Burnt Studios will not grant refunds or returns if the customer feels the product does not look exactly like that in the picture.
 
Intellectual property
All intellectual property rights, including copyright, in all materials, including trademarks, logos, photographs, images, text and other graphics which form part of the Site are owned by the Company alternatively the Company is the lawful user thereof. Such rights are protected by both South African and international intellectual property laws. All data and information communicated to or from the Site and/or any Site information as well as the database is the sole property of Burnt Studios.
The Company grants you permission to view, electronically copy and print portions of the Site for the sole purpose of placing an order with the Company for any of the Products.
Any use of materials on the Site other than for the purpose noted above including, without limitation, the unauthorised submission, removal, modification, dissemination, copying or distribution of copyrighted or other proprietary content, without the prior written consent of the Company and/or the lawful trademark and/or copyright owner (if applicable), is prohibited and constitutes an unlawful infringement of the intellectual property rights of the Company and/or such trademark and/or copyright owner.
 
Trademarks
"Burnt", “Burnt Studios”, the Burnt Studios logo as well as the Company logo and all other marks, logos and trade names appearing on this Site are trademarks of either the Company, its holding company or affiliates in the Republic of South Africa, or of third parties who have authorised the Company to display such trademarks on the Site. Nothing contained on this Site should be construed as granting, by implication or otherwise, any license or right to use any of the trademarks displayed on this Site without the express prior written consent of the Company. Your use of any of the trademarks displayed on the Site or in any of its contents is strictly prohibited. You may not copy, reproduce, publish, upload, post, transmit, distribute or modify any of the trademarks appearing on this Site. You further undertake not to infringe any right of the Company or trademark owners in respect of such trademarks. The use of the trademarks on any other website or networked computer environment is prohibited.
 
Unlawful use
You shall not use this Site to send or post any message or material that is unlawful, harassing, defamatory, abusive, threatening, obscene, sexually orientated, racially offensive, profane or which violates any applicable law and you hereby indemnify the Company against any loss, liability, damage or expense of whatever nature which the Company or any third party may suffer and which is caused by or attributable to, whether directly or indirectly, your use of the Site or any of our social media platforms.
 
Links and advertising
No person, business or other website may link to any page on this Site without the prior written permission of the Company.
External hyperlinks may be provided on the Site, but such links are beyond the Company’s control. You shall not interpret the provision of such hyperlinks as constituting any relationship between the Company and any linked third party, nor as an endorsement by the Company of such third party. Hyperlinks provided on this Site to other websites are provided as is and the Company does not necessarily agree with, edit or sponsor the content of such websites. The use of, or reliance placed by you on any external links provided on the Site is entirely at your own risk.
Any advertising and other promotional material that may be displayed on the Site from time to time shall not be interpreted as constituting any relationship between the Company and any third party placing such advertising or promotional material on the Site, nor as an endorsement by the Company of such third party. Any use of, or reliance placed by you on such material is entirely at your own risk.
 
Disclaimers and exclusions of liability
You expressly agree that use of the Site is entirely at your own risk. The Site and its contents are provided on an ‘as is’ and ‘as available’ basis and has not been compiled to meet individual requirements. It is your responsibility to satisfy yourself, prior to entering into this Agreement, that the service available from and through this Site meets your requirements, and is compatible with the hardware and/or software used by you.
The Company makes no representations nor gives warranties of any kind, whether express or implied including, without limitation, with respect to the Site, its contents, the accuracy thereof or any warranties or representations regarding the effectiveness of any security or encryption facilities or with regard to the availability of Products and/or delivery arrangements and times.
The Company disclaims all representations and warranties including, but not limited to, warranties as to the availability, accuracy or content of information, Products or services, and warranties of merchantability or fitness for a particular purpose of information, goods or services.
The Company does not warrant that the functions provided by the Site will be uninterrupted or error free, or that the Site or the server that makes it available are free from viruses or other harmful components. Save as expressly set out herein, the Company shall under no circumstances whatsoever be liable to you, including without limitation, as a result of or in connection with the Company’s negligent acts or omissions or those of their employees, agents, representatives, sub-contractors or other persons for whom in law they may be liable (in whose favour this constitutes a contract or undertaking for their benefit), for any direct, indirect, incidental, special or consequential loss or damage of any kind whatsoever or howsoever caused (and whether arising under contract, delict or otherwise), sustained by either you, the recipient of the Products or services or any other person arising from or as a result of any sale concluded in terms of this Agreement, the delivery, non-delivery, incorrect, erroneous or late delivery, the use or possession of the Products or services.
The Company, its directors, employees, sub-contractors, agents, representatives, affiliates and suppliers shall not be liable for any loss, damage (whether direct, indirect or consequential) or expense of any nature whatsoever which may be suffered as a result of or which may be attributable, directly or indirectly, to the use of or reliance upon the Site (including any information contained thereon) or the Internet. You hereby indemnify the Company from and against any loss or damage suffered or liability incurred including, without limitation, in respect of any claim or demand by any third party by reason of any act or omission on your part or that of any family member, agent or representative acting on your behalf in connection with transactions concluded on the Site and/or in terms of this Agreement and/or in relation to the receipt of Products or services supplied by the Company pursuant to any such order.
Notwithstanding any other provisions contained herein, the Company’s liability whether in contract or delict arising from any breach of any obligation in terms of this Agreement, negligence or otherwise shall not exceed at any time the value of the Product(s) in respect of which any such dispute or claim arises.
By accessing this Site, you warrant and represent to the Company that you are legally entitled to purchase the Products and that all the details you have provided are true and complete.
Information, ideas and opinions expressed on this Site should not be regarded as professional advice or the official opinion of the Company. You should consult professional advice before taking any course of action related to information, ideas or opinions expressed on this Site.
 
Security
You agree and warrant that your user name and password shall be used for your personal use only and shall not be disclosed to any third party. You agree that the Company shall be entitled, at all times, to take all reasonable steps to ensure the integrity and security of the Site, including associated applications.
The content contained on the Site may be used by you for your own personal shopping and information purposes only. In using the Site you warrant that you shall not infect it with any computer programming (such as a virus) that may damage, interfere with, delay or intercept any data or information on the Site and you hereby indemnify the Company for any damage caused by any act attributable to you. Any person that delivers or attempts to deliver any damaging code to this Site or attempts to gain unauthorised access to any page shall be prosecuted.
Shipping

At Burnt Studios we make use of DHL, The Courier Guy, DawnWing and CourierIt (the majority of the time, not exclusively) to ship all our packages. They are some of the most recognized and well now courier services in SA and they offer great service. Once your package has been delivered to them it is out of our control and they will be responsible for the delivery to you. Burnt Studios is not responsible if your order has not been delivered by the estimated delivery date once we have handed your parcel over to our courier service. If there is a delay in the delivery (due to strikes etc.) there will not be refunds, nor is Burnt Studios responsible for any lost or damaged parcels.

Please allow 3-5 Business days for your order to be delivered. Shipping may be delayed on big Sale events (Black Friday or Flash Sale).

Please make sure that the shipping address provided is correct. We will not be held responsible for parcels going missing because we have not received the correct address.

Please note: The courier company may contact you if you need to pay tax and duties to the tax authorities of the specific country upon import of the goods. We cannot be held reliable for any additional tax or duty fees. 

General terms
The Company may, in its sole discretion, suspend or terminate the operation of the Site at any time without prior notice to you and without the need to give you reasons for such termination or suspension.
We may change the terms of this Agreement from time to time without notice to you. Any amendments will take effect immediately on posting of the amendments on the Site. You shall be deemed to have accepted any changed terms should you continue to use the Site.
If any provision of this Agreement is unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of the remaining terms.
This Agreement constitutes the whole agreement between the parties relating to the subject matter hereof. Any indulgence of extension of time granted by the Company to you shall not be construed as a waiver or variation of any of our rights or remedies.
At the option of the Company, any dispute arising out of the Agreement may be brought in any Magistrates’ Court of competent jurisdiction notwithstanding that the amount in issue may exceed the jurisdiction of such court.
The Site is hosted and managed in the Republic of South Africa and this Agreement is accordingly governed by the laws of the Republic of South Africa.
Any dispute of any nature whatsoever arising between the parties on any matter provided for in, or arising out of this Agreement, may be submitted to confidential arbitration South Africa in terms of the expedited rules of the Arbitration Foundation of Southern Africa.
General Information
The Company’s:
Electronic communication
When you use or visit this Site, or send electronic communications to the Site including, without limitation, e-mails or place orders for Products, you:
  • consent to receiving communications from the Company electronically;
  • agree that all notices, disclosures and other communications sent by the Company, including this Agreement, satisfies any legal requirements, including but not limited, to the requirement that such communications should be ‘in writing’;
  • agree that the Company may use your information to contact you about promotions and special offers if you have indicated during registration that you would like to receive such information. You are entitled, at any stage, to opt out of this service.
  • agree that the Company may disclose your personal information in response to a specific request by a law enforcement agency, subpoena, court order, or as otherwise required by law, e.g. for accounting purposes.
BURNT STUDIOS ONLINE SITE TERMS
To purchase Products from the Burnt Studios Online Site you must first register your personal information. Registration and/or use of the Burnt Studios Online Site constitutes acceptance of this Agreement by you, and shall accordingly apply as between the Company and yourself.
Online registration
To register to buy Products you will be required to provide us with your personal information including payment details and your South African delivery address and contact information to enable us to verify who you are and deliver any products that you have bought.
You may be required to choose a user name and a password, or elect to checkout as a guest customer. Please keep your password secret. The Company accepts no liability for any damages suffered or losses incurred as a result of the misuse or loss of your password. In this regard you represent and warrant that your user name and password shall:
  • be used for personal use only; and
  • not be disclosed to any third party.
You will be required to login with your username and password each time you want to buy Products on the Burnt Studios Online Site. Should you want to review and/or change any of your particulars please go to ‘My Account’.
Guest customers will not have a registered account. You will be able to track and trace the progress of your orders delivery, using the link in the email that is sent to you. Your delivery address and contact details is required to facilitate the delivery of your order.
 
Security
The Company will endeavour to ensure that your personal information and/or Credit Card details are protected as they travel over the Internet. Given the current state of Internet technology however, there is no guaranteed secure transmission of data over the Internet. Therefore the Company cannot guarantee the absolute security of any information you transmit to us or which the Company transmits to you.
 
Pricing
Subject to availability, the price you pay for Products will be the price shown on the Burnt Studios Online Site on the date that you pay for such Products.
Special promotions may be subject to certain conditions, including stock availability and limited offer stipulations. Time-based pricing is only available during the times and dates stipulated on the Site.
The price of each Product is the price displayed on the Burnt Studios Online Site. In the event of a Product being on special, this price will be displayed. All prices are quoted in South Africa Rand (ZAR) and includes VAT at the rate of 15%, unless otherwise stipulated. Prices are only valid on the Site and not in Burnt Studios stores. Delivery costs are calculated taking into account the area of delivery as well as the weight and product dimensions of each Product being delivered and are quoted separately.
Whilst all precautions are taken by the Company to provide the correct pricing on this Site, in the event that an error does occur, the Company will make every effort to contact you to cancel the purchase and provide a full refund for the original amount paid. As such the Company will not be obliged to provide you with the affected Product at such incorrect price.
Free delivery promotions are limited to web orders only.
 
Payment
Prior to delivery of the Products to you, the Company shall be entitled to debit the Credit Card supplied by you on acceptance of your order should you be paying with a Credit Card.
Should you pay for the Products via EFT the Products will only be delivered to you once your payment has cleared in the Company’s bank account, and is reflected as a payment on the Company’s bank statement within 3 working days of date of the placement of your order.
In order to protect our interests as well as yours, the Company may scrutinise transactions to prevent attempted fraud. A transaction may be refused if the Company is not satisfied that it is legitimate.
 
Stock availability
The Company cannot always guarantee the availability of stock. If we are unable to supply each and every Product ordered or in the quantities ordered, you nevertheless agree to accept delivery and make payment for the items correctly delivered. Stocks of all goods on offer are limited. The Company shall use its reasonable efforts to discontinue the offer as soon as stock is no longer available.
Under no circumstances will the Company be liable to you for failing to supply Products ordered by you if the shortage of stock or capacity is due to circumstances beyond the Company’s control. In such circumstances, the Company will take reasonable steps to inform you of the shortage of stock or capacity as soon as it is practicable to do so.
Confirmation of orders
Orders placed on the Burnt Studios Online Site constitute your offer to purchase Products subject to this Agreement. Your offer is deemed to have been accepted by the Company when payment is received from the issuing bank in the case of payment via Credit Card, or when your payment reflects on the Company’s bank statement in the case of payment via EFT. Failure by the Company to formally confirm or notify acceptance shall not affect the validity of the sale or the enforceability thereof.
Giveaways
When Burnt hosts a giveaway either on any of their own platforms or on the platform of another company these terms and conditions apply. The giveaway winner will be selected by means of a random draw and the judge's decision is final. Giveaway items are non-refundable and no-returnable. Giveaway prizes can not be redeemed for cash. By entering a giveaway you accept that Burnt or the hosting company of the giveaway has the right to make use of your contact details. You also accept that your details can be used in order to announce the winner of the prize on any platform of their choice or for additional marketing activities. Giveaway prizes are for RSA residents only and can't be shipped abroad. Winners have to meet ALL provided criteria in order to qualify for the prize. No late entries will be accepted. Burnt can not be held responsible for any fraudulent or scamming activity of any form or nature. Burnt Studios reserves the right to end a giveaway at any time if need be. 
Burnt reserves the right to pack the winner's giveaway hamper with products of their choice. The value is based on the original asking price of our products. If a product is on sale or goes on sale during the campaign, the value of its original price will be used to count towards the final value of the hamper. There might also be physical prizes included in the giveaway.
London Marathon: The discount codes are valid during our launch month until 23:59 on 21 April (Not valid after the London Marathon is completed). The codes can only be redeemed online & on one order only. Do not share this code with anyone, you will be unable to redeem the discount should your code get used before your purchase. Only for use on burnt.co site & will not work on our South African site. No refunds, returns or exchanges will be allowed to be made on this purchase. Not valid during any of Burnts major sales.

Terms and Conditions for Burnt 100k Campaign:

The “campaign” refers to the Burnt 100k giveaway campaign.

The campaign will commence on Friday 5 April and run until 15 April.

Winners will be announced on the @burnt.studios stories at these times:

  • Winners 1-10: 6 April at 2pm
  • Winners 11-20: 7 April at 2pm
  • Winners 21-30: 8 April at 2pm
  • Winners 31-40: 9 April at 2pm
  • Winners 41-50: 10 April at 2pm
  • Winners 51-60: 11 April at 2pm
  • Winners 61-70: 12 April at 2pm
  • Winners 71-80: 13 April at 2pm
  • Winners 81-90: 14 April at 2pm
  • Winners 91-100: 15 April at 2pm

The campaign will run for 10 consecutive days.

10 x R1000 vouchers will be released to 10 winners every 24 hours over 10 days.

Should you wish to use your voucher on the international site, please reach out to us on Instagram Direct Message (DM) with your request.

We will swap your voucher for a £50 voucher to be used exclusively on our international website.

The total number of vouchers awarded will not exceed 100 vouchers.

The vouchers can be redeemed for purchases on the burnt.co.za or burnt.co (international site) online store only.

Vouchers cannot be exchanged for cash.

Entrants must be following the official @burnt.studios Instagram account to be eligible to win as well as follow all the required criteria as laid out in the announcement post when the campaign goes live.

Entrants Instagram page must be public in order for us to see your entry, no entries from private accounts will be picked up by our winner picker software.

Each draw will be vetted by the board of directors to ensure:

  • All giveaway mechanics where fulfilled (follow/share/comment)
  • The winning accounts are true eligible winners and not bots/spam/duplicates/private.
  • That the draw takes place fairly and accurately.

Your Instagram username is only eligible to win once. Should your username be drawn a second time, it will be replaced with the next winner in line.

All winners will be drawn from a reliable and random winner generating software.

Employees of Burnt and their immediate family members are not eligible to win in the campaign. Each participant may enter multiple times to improve their chances. You will receive your voucher code via DM within 24 hours of winners being announced on stories. Winners will be announced on the @burnt.studios Instagram account.

Winners will receive a unique voucher code via direct message on Instagram. Vouchers are valid until September 30, 2024, and cannot be used during sales or promotional events. Each voucher code can only be used once and cannot be shared or transferred to another individual.

By participating in the campaign, participants agree to abide by these terms and conditions. Burnt reserves the right to disqualify any entrant who violates the terms and conditions or engages in fraudulent behaviour. Burnt reserves the right to modify, suspend, or terminate the campaign at any time without prior notice. By accepting a prize, winners grant Burnt the right to use their username on our Instagram stories. All personal information collected during the campaign will be used solely for the purpose of administering the campaign and will not be shared with third parties without the consent of the entrants. By participating in the Burnt 100k Followers Campaign, entrants agree to be bound by these terms and conditions.

 

Additional Terms and Conditions for Bonus Day of Burnt 100k Campaign:

  1. The bonus day refers to the additional day added to the Burnt 100k giveaway campaign, offering a R2500 voucher prize for 4 winners each.
  2. The bonus day will commence on 15 April and run until 16 April.
  3. Winners will be announced on the @burnt.studios stories on 16 April.
  4. The bonus day prize consists of R2500 vouchers, redeemable for purchases on the burnt.co.za or burnt.co (international site) online store only.
  5. International customers wishing to use their voucher on the international site may opt to swap their R2500 voucher for a £110 voucher to be used exclusively on our international website, as per the terms outlined in the main campaign T&Cs.
  6. The total number of bonus day vouchers awarded will not exceed 4 vouchers.
  7. Vouchers cannot be exchanged for cash.
  8. Entrants must adhere to all requirements and criteria as outlined in the announcement post for the bonus day on Instagram.
  9. Each entrant's Instagram page must be public for eligibility. Entries from private accounts will not be considered.
  10. Each draw will be conducted fairly and accurately, vetted by the board of directors to ensure compliance with giveaway mechanics and the eligibility of winning accounts.

Terms and Conditions for BURNT TONE VIP PRE-LAUNCH:

The “campaign” refers to the Burnt Tone VIP Pre-Launch campaign.

The campaign will commence on Sunday 7 April and run until 10 April Midnight.

For three days post launch (7th April at midday until 10th April midnight), email subscribers who signed up to the Burnt Tone waiting list can use their unique discount code emailed to them to get a 25% discount off the Burnt Tone Program. 

The discount is only available online. Purchasers must apply their unique code emailed to them to checkout to redeem the discount.

The discount is only available for one use per customer and is valid until the 10th of April. 

Discount can only be used on the Burnt Tone program and cannot be exchanged for cash. This discount can only be applied to an online purchase.

 

 

Terms and Conditions for Burnt Giveaway

 

  1. Introduction

1.1 These terms and conditions (the "Terms") govern the Burnt Giveaway (the "Giveaway") organized by Burnt ("Promoter").

5.2 Prizes are non-transferable, and no cash alternative will be offered. The Organizer reserves the right to substitute any prize with another of equivalent value without giving notice.

5.3 Any costs outside of the above will be payable by the winners, this is included but not limited to: Visas, transport to their local UK airport, food not included above, transport and activities around CPT not mentioned in the above.

5.4 Should you wish to extend your stay, you are welcome to book your own accommodation/activities etc - we would be happy to book the return flight back on a later day of your choice.

5.5 Please note that should any changes be made to the times you wish to fly, the winners will be responsible for paying the excess amount on the new flight details, the hotels cannot guarantee they will be able to accommodate you, should you change your flights on your own accord without informing Burnt.

 

  1. Winner Selection and Notification

It is the winner’s responsibility to ensure that any information provided to us is accurate, complete and up to date. The Promoter nor any of its third-party suppliers will not and cannot be held liable for any errors/omissions caused by the Participant when providing Personal Information (as defined by the Protection of Personal information Act, 4 of 2013) to the Promoter, whether this is upon entering into this Giveaway or where a Winning Participant is providing Personal Information when claiming the Prize.

 

6.1 Winners will be selected at random from all eligible entries received during the Entry Period.

6.2 The draw will take place on 25 September at 9am (GMT+1).

6.3 Winners will be notified via email within 7 days of the draw date. Proof of valid UK ID & citizenship will be requested in order to move forward with said prize.

6.4 If a winner does not respond within 7 days of being notified, or is not a citizen of the UK, the Organizer reserves the right to select an alternative winner.

7.1 The process of booking dates for the trip will be seen as a collaborative effort between the accommodation partners, Promoter & the winners. Please note that best efforts will be made to accommodate the right dates for the winner, however any insulting, rude or disrespectful behaviour from the winners is grounds for cancellation - and an alternative winner will be selected.

8.1 The Promoter reserves the right to cancel, terminate, modify, or suspend the Giveaway if any technical, administrative, or other issues affect the integrity or fairness of the Giveaway.

8.2 The Promoter is not responsible for any unauthorized access to, or alteration of, entries; technical failures; or any other causes beyond the Organizer's control.

8.3  Should any dispute arise in relation to the interpretation of these giveaway rules, the decision of the Promoter shall be final and no correspondence shall be entered into further.

8.4 The Promoter reserves the right to cancel, terminate, modify or suspend the Giveaway in the case of Force majeure.

9.1 Should it be necessary to film any content of the winners whilst in South Africa, the winners agree to make themselves available. The Promoter and participating giveaway partners reserve the right to utilise all footage on any of their platforms. By participating in our Review Giveaway Campaign, you acknowledge that leaving a review of our product(s) enters you into the competition. It is important to note that leaving a review does not guarantee the prize; rather, participants stand a chance to win once entered. The total prize value, comprising the winner's entire order value plus a £250 Burnt voucher, will be awarded as a gift voucher. The winner will be chosen randomly from eligible entries and contacted personally; failure to respond within 48 hours will result in the prize rolling over to the next selected candidate. We reserve the right to modify or terminate the campaign and its terms at our discretion. The next winner will be announced on the 24th of February 2025.

  • You must go through the full program. 
  • You must have completed all the lessons, activities, watched all the video lessons in the program.
  • You must have completed the training with proof of all your sessions (eg strava sessions or garmin results).

Risk and Ownership
Risk in the Products shall pass to you upon delivery of the Products at the delivery address chosen by you. Until payment is received in full for any goods sold, ownership in the Products shall remain with the Company and such Products shall be returned and/or surrendered to the Company following receipt of a default notice from the Company.
 
Agreement of sale
An agreement of sale in respect of a Product between the Company and you only come into effect if and when a Credit Card authorisation is received by the Company from the issuing bank or when the Company’s bank statement reflects your payment via EFT, and the order has been invoiced. The Company reserves the right to:
  • refuse to accept and/or execute an order without giving any reasons, and

  • cancel orders in whole or in part in its sole and absolute discretion. 

Warranties
To the extent that the Products are altered contrary to the instructions, or after having been delivered to the delivery address stipulated by you the Products or property in which the Products are installed have been subjected to misuse or abuse, the Company and/or manufacturer of the Products will not be obliged to honour any warranties applicable to such Products. Warranties do not apply to ordinary wear and tear. Warranties do not apply to any clothing products currently listed on the site. 

Our Active Jewellery has a 3-month warranty on discolouration only. A jewellery piece that has lost significant gold colour in the 3 months since purchase will be replaced. If the item is no longer in stock, it can be replaced with another jewellery item of the same value.

The warranty is not applicable to damages including broken clasps, chains and day-to-day wear and tear. 

Earrings cannot be returned or exchanged because of hygienic reasons.
